The 6th US Circuit Court of Appeals ruled against Kalshi on Friday, stating that states can regulate its sports-event contracts under their gambling laws.
The court said that the prediction markets operator has not shown that its contracts satisfy the definition of a "swap" to fall within the scope of the Commodity Futures Trading Commission's exclusive jurisdiction.
The court added that Kalshi also failed to show that Ohio's sports gambling laws are preempted.
