一名位于波士顿的联邦法官将暂时暂停其先前撤销对新H-1B工人征收10万美元费用的裁决，同时特朗普政府正在寻求上诉法院的紧急暂缓令。
利奥·索罗金（Leo Sorokin）法官在6月8日的裁决中认定，这项六位数的特朗普政府收费侵犯了国会的专属征税权，并违反了权力分立原则。
该裁决支持了由20个民主党主导州提起的诉讼，也是该政策在法律上的首次败诉。这一政策曾颠覆以高技能工人为核心的关键签证项目。
特朗普政府几乎立即对该裁决提出了上诉，并于6月12日提交了一项动议，请求索罗金法官在等待美国第一巡回上诉法院做出决定期间，暂缓执行其裁决。
索罗金表示，在抗诉法院介入之前，他将暂缓执行其在马萨诸塞州联邦地区法院作出的裁决。
美国司法部律师表示，政府很可能会成功论证该费用是对对外贸易和移民权力的合理行使。
